Since its entry into force in November 2023, the Law on Public Property has aimed to centralize the administration of public property in Kosovo. However, delays in adopting the necessary sub-legal acts have left many businesses at a standstill, particularly those reliant on public property leases and usage.
Recognizing the urgency of the situation, private sector representatives sought support, leading to our involvement in assisting the Ministry of Justice and the Government in drafting these regulations. As part of our efforts, we organized two consultation sessions, facilitating discussions and reviewing feedback from key stakeholders to foster an effective regulatory framework.
The long-awaited sub-legal acts have now been approved by the Government of Kosovo, serving to:
1) Regulate public property transfer criteria and public property leasing procedures and criteria;
2) Establish the manner for record-keeping mechanisms for public property;
2) Enable the organization and operationalization of the Office for Public Property Administration within the Prime Minister’s Office.
We appreciate the efforts of the Prime Minister’s Office and the Ministry of Justice, who sponsored these sub-legal acts, as well as the contributions of other public and private sector actors who played a key role in facilitating this process!
The approval of these sublegal acts paves the way for the government to take the next procedural steps toward effective implementation of the law and the full operationalization of the Office for Public Property Administration — a crucial step toward unlocking economic potential and ensuring legal clarity for the businesses.
